Is Dave Winer trolling, or is he genuinely as retarded as he appears?
Somebody (and I mean somebody that he would actually listen to, rather than somebody he would ignorantly disparage) needs to explain to him the myriad gaping flaws in these posts before any more of his readers get the false impression that his analogy has the slightest merit.
Scripting News has turned into a mouthpiece of FUD and abject idiocy. Very disappointing. It's reached the point where the only reason I read it is to keep an eye on which windmills Winer and his followers will tilt at next.

They seem pretty reasonable to me.
I'm with you on this one... Winer wanted to get the EFF and Cory Doctorow to admit there was "some sort of line" that could not be crossed. So, he created these outrageous examples of content exploitation.
Only after this did he get contacted by Cory Doctorow apparently making a case that Winer's hypothetical was out of line with his thinking on
"content" or IP. I listened to Cory "debate" Scobel
on this issue and it was very clear that he considers content to be undre severe restriction until the reader gets a copy and then a new set of rights are dominant... All of this relates back to Winer's outrage over the Google Toolbars use of autolinking a page's content. Doctorow sees that as entirely fair-game and Winer wants an opt out for himself and anyone else that wants to avoid unintentially being associated with a link to Amazon, as an example. It's a tricky issue but I think Winer is just making the debate less intelligible by his examples that make it appear that his "opponents" hold views that they do not.
H'e an internet crank and trolling appears to be the right verb in this context.
